Last updated: 2024

Deposit

Deposit: 20% non-refundable deposit to schedule and start work.

Compensation: Client shall pay as set forth above. Price is subject to change, with customer's approval.

Invoicing and payment: An invoice will be issued to the client upon completion of work. Client shall pay the remaining balance in full the day of job completion. Completion of work will be determined by Boulder Paint Ltd.

Schedule

Customers are preliminarily scheduled once the down payment is received. If a project needs to be rescheduled to a later date due to unforeseen weather, material availability or contractor schedule, the original quoted price will be honored. If a project needs to be rescheduled due to the owner's schedule/availability, the price may be adjusted to reflect loss of work time caused to BP, any rising cost of materials, labor, or tax rates.

Paint and Materials

  • Our painters will paint to cover and will apply the correct amount of paint to cover old colors. The number of coats necessary will be determined by Boulder Paint Ltd.
  • Darker color paint can be difficult to cover with a lighter color paint, and therefore may require more coats of paint than normal to achieve a satisfactory and uniform appearance. We try our best to reflect this in the original quote. However, if the decision to cover dark paint with lighter paint occurs after the original quote is accepted by the owner, the price may be updated to reflect additional paint and labor costs.
  • All paint colors must be chosen by the owner at least 1 day before work is scheduled to begin. If a color change is requested once BP has already bought the paint, the owner will be charged for the cost of all paint already purchased by BP in the originally chosen color. If the color change request is made by the owner after painting has already begun the owner will be charged on a time and materials basis for re-work.
  • Jobs in which colors are matched will not be perfect without the paint color code and name. BP will attempt to get the match as close as possible.
  • BP is not liable for any fees or charges from the owner's HOA, Covenant or Metro District. If an architectural review form/color form is required, it is up to the owner to submit this form.
  • When puttying and caulking are included in the agreement, BP contractors will only replace caulk in areas that are missing material and have cracked caulking – more extensive putty and caulking work will require special notation on the agreement with the additionally charge included in the given estimate price.
  • BP is not an EPA Lead Base Paint Abatement & Removal Company. BP acknowledges and agrees to handle lead-base paint in compliance with all applicable federal, state, and local laws and regulations.

Warranty

  • BP's warranty covers labor for the length of time stipulated on the original quote from the date of the project's completion. It is the responsibility of the owner to keep all leftover paint containers in good condition so that it may be used in case of warranty work. If more paint is required, it is the customer's responsibility.
  • This warranty does not include the following:
    • Incidental damage caused by accident, abuse, normal wear and tear, weather damage (hail, wind, snow, moisture, temperature changes), and cracks caused by expansion.
    • Painted or stained surfaces that people walk on.
    • Doors and railings in high traffic areas.
    • Painted vinyl
    • If customer supplies primer, paint, stain, varnish, etc.

Payment

  • By submitting a deposit to BP, the customer acknowledges the acceptance of the estimate in its entirety and authorizes BP to proceed with performing the job as outlined in the estimate. The receipt of the deposit also signifies the customer's acceptance of the terms and conditions of the estimate and their commitment to engage the company's services for the specified job.
  • If a remaining balance goes unpaid longer than 30 days and the owner and company have not arranged a payment plan, a 2% late fee may be charged in addition to the remaining balance beginning after 30 days, and every month thereafter until balance is paid.

Other Conditions

  • If defects or other unforeseen conditions are discovered during the painting process which could not reasonably have been discovered by BP's agent upon first inspection (invisible defects, hazardous materials, etc.) the owner will be charged on a time and materials basis plus a standard markup for overhead and profit on the additional costs incurred as a result of such conditions.
  • The owner shall disclose any knowledge of hazardous materials (as defined by law) known or suspected. Should hazardous materials be disclosed or discovered after this agreement is signed, then BP may terminate this agreement and the owner agrees to pay for all labor or materials expended plus overhead and profit.
  • It is the owner's responsibility to ensure all pictures are removed from walls and furniture is moved to the center of the room to give our painters sufficient room to work, unless otherwise specified on the estimate. If certain appliances need to be moved to paint the entire surface, BP is not responsible for scratches to floors or leakage. BP requests that owners remove blinds and drapes in rooms being painted. If blinds/drapes are not removed when work is to begin, BP can remove them if given approval by the owner. BP is not liable for any damage done to weather strips, blinds/drapes during the removal/reinstallation process.
  • BP uses low tack tape to ensure smooth transition lines. There is an inherent risk that paint may peel while removing the tape. BP will touch up with the original paint to be supplied by the owner at no cost. If the original paint is not available, the closest match will be used for touch ups and charges will apply.
  • Alarms are to be turned off while BP painters are on site, and pets are to be secured by the Owner. BP is not responsible for setting alarms, is not liable if the owner is locked out of the property and is not liable if pets are unsecured and leave the premises.
  • If BP is painting new drywall the owner is responsible for ensuring drywall is in satisfactory condition before painting begins.
  • If BP's painting is damaged by other trades after the painting job is finished, BP will bill the owner for touch ups or re-work.
  • BP follows all work protocols and craftsmanship per industry standards, OSHA, and the PCA.
  • Painters will continue to return to the jobsite every day during normal operating hours until the project is complete, except when due to weather complications or product availability.

Walk Throughs and Touch Ups

The owner is to be available to meet with BP the day the project begins to confirm all details of work. The owner must also be available for a walk-through with BP upon job completion to identify any needed touch ups. Crew will address any touch ups at that time. If the owner is not available for a walk-through upon job completion, BP will send painters - on a single trip - when their schedule permits for a walkthrough with the owner. Requests for more than one touch up trip, may incur additional trip/labor charges.
